You agree and acknowledge to be bound by the following Terms of Service (“Terms”) and Privacy Policy by accessing Vivian’s Vision website (“Site”) or by using the services offered by Vivian’s Vision (“Services”). Please do not access the Site or use the Services if you do not agree to these Terms. Vivian’s Vision reserves the right to change these Terms at any time. So we suggest that you check this page regularly for any changes.

Pricing:

While we try to make every attempt to avoid the errors, data sometimes might be inaccurately displayed on the Site. Vivian’s Vision will not honor any inaccurate or erroneous prices. Vivian’s Vision reserves the right to change the prices without prior notice.

Returns:

Each Vivian's Vision jewelry design is hand made to order. I take great care to ensure that it arrives to you in perfect condition. I want you to be extremely satisfied with your purchase…so satisfied, in fact, that I hope you will recommend us to all of your family and friends!

If for some reason you are unhappy with your purchase you may return/exchange your unworn purchase within ten (10) days of the shipping date.

When returning an item:

• Please indicate whether you want a refund or if you wish to exchange the item for another piece.
• Pack the item in its original packaging.
• Packages must be returned prepaid. I do not accept COD deliveries.
• If this is a gift and you do not have the receipt, please contact me by email prior to sending the item back so we may better serve you.

Vivian's Vision will repair or exchange any merchandise which you receive damaged. All credit card refunds will be applied to the same card used for the original purchase.

Comparison Buying:

Comparison buying means buying several products with the purpose of keeping the product you like best and returning the rest. Please note that we do not permit comparison buying since it results in excessive restocking and inventory overhead.

All orders are shipped free courtesy of Vivian's Vision. Please allow five to seven business days for delivery of your special package from UPS Ground.

Free shipping is extended only to customers with a United States shipping address.

Content:

By posting any kind of content on Vivian’s Vision, you are granting permission to us and others to access, use, and edit it. You also grant to Vivian’s Vision a royalty-free, worldwide, transferable, non-exclusive, right and license to use such content in all media existing now or created in the future as Vivian’s Vision deems necessary. You agree that Vivian’s Vision will have no obligation to keep any of your content confidential. You agree not to post any copyrighted content on the Site.

Gift Certificate:

• Gift Certificates must be redeemed only through Vivian’s Vision's website
• Gift Certificates and unused portions of Gift Certificates should be spent within 6 months from the date of issuance, which is the "expires on" date included with the Gift Certificate.
• Gift Certificates are not redeemable for cash and can not be returned for a cash refund. Gift Certificates are not transferable.
• Gift Certificates can not be used to buy Gift Certificates.
• Vivian’s Vision is not responsible for lost or stolen Gift Certificates.
• Gift Certificate cash value is 1/10 of one cent.
• Use and/or purchase of a Gift Certificate constitutes acceptance of Vivian’s Vision's Terms of Service and Privacy Policy.

Intellectual Property:

Vivian’s Vision solely and exclusively owns all the intellectual property and other rights, title and interests in and to the Services and the Site, except as expressly provided for in these Terms.

Limited License:

Subject to your agreement with these Terms, Vivian’s Vision grants you a limited revocable license to access and use the Site and the Services for its intended purposes. This license does not include the right to:

• collect or use information contained on the Site for purposes prohibited by Vivian’s Vision
• compete with Vivian’s Vision
• create derivative works based on the content of the Site or download or copy the Site except for page caching.

Vivian’s Vision may withdraw the license granted to you if you use the Site in a manner that exceeds the scope of this license or breach these Terms.

Vivian’s Vision provides the Site and the Services on an “As Is” and “As Available” basis. Vivian’s Vision does not warrant that the Site and Services will be uninterrupted, or the information contained on the Site will be accurate, reliable or error-free, or that defects will be corrected.

Under no circumstances shall Vivian’s Vision be liable for any direct, indirect, special, incidental, consequential or punitive damages of any kind, or any other damages whatsoever (however arising, including by negligence), including without limitation, damages related to use, misuse, reliance on, inability to use and interruption, suspension, or termination of the Site or Services, damages incurred through any links provided on the Site and the non-performance thereof and damages resulting from loss of use, sales, data, good-will or profits, whether or not Vivian’s Vision has been advised of such possibility.
